To:  The Central Local Health Integration Network (the “LHIN”).

From:  The Board of Directors (the “Board”) of Addiction Services for York Region (the “HSP”)

Date:  June 25, 2020

Re:  April 1, 2019 – March 31, 2020 (the “Applicable Period”)


Unless  otherwise  defined in this declaration, capitalized  terms  have the same meaning  as set out in the M-SAA between the LHIN and the HSP effective April 1, 2019.

The Board has authorized me, by resolution dated June 25, 2020, to declare to you as follows:

After making inquiries of the Executive Director, Penny Marrett, and other appropriate officers of the HSP and subject to any exceptions identified on Appendix 1 to this Declaration of Compliance, to the best of the Board’s knowledge and belief, the HSP has fulfilled, its obligations under the service accountability agreement (the “M-SAA”) in effect during the Applicable Period.

Without limiting the generality of the foregoing, the HSP has complied with:

  1. Article 4.8 of the M-SAA concerning applicable procurement practices;
  2. The Local Health System Integration Act, 2006; and
  3. The Public Sector Compensation Restraint to Protect Public Services Act, 2010.

Appendix 1 – Exceptions

The impact of COVID-19 was begun to be felt by Addiction Services for York Region (ASYR) in late February when confirmed presentations were postponed or cancelled. This continued into March when, at the beginning of March, nearly all of the awareness presentations were postponed or cancelled until further notice. In mid-March, ASYR moved to having all staff work remotely. Group sessions were not offered at that time as ASYR was focused on ensuring that staff were able to provide services to our clients remotely through a secure platform that was PHIPA compliant,

As a result of the above, ASYR was not able to achieve the targets for group sessions.

ASYR is moving toward offering group sessions remotely, starting in July 2020. ASYR is concerned that with COVID-19 and with current public health directives for physical distancing, etc., ASYR will be challenged to achieve its targets for the 2020-2021 fiscal year. ASYR is working hard to put strategies in place to do its best to achieve the targets set out in the M-SAA.

Appendix 1 – Exceptions

Addiction Services for York Region (ASYR) was not compliant in all areas of its programs and services. Due to staff gapping in some areas and a reduction in presentations, ASYR was unable to achieve its targets in Problem Gambling Awareness.

ASYR was also challenged in 2018-2019 with a large infusion of one-time funds in later part of Q4. With these funds, targets in a number of programs and services was increased. ASYR and its Wellness Collaborative partners worked very hard to achieve additional targets, given the short time frame, we were not successful in all areas.

ASYR is committed to achieving its targets annually and will continue to work hard in providing programs and services to people in need while working to achieve the annual targets that are set out by the funder.

Appendix 1 – Exceptions

Due to the unexpected passing of one of our ASH clients earlier in the fiscal year and the subsequent vacancy of this apartment for several months as well as two other clients from the ASH program leaving their apartments, ASYR did not meet its targets for 2016-’17.

Individuals are moving into the apartments and it is expected that ASYR will meet its targets in this Functional Centre in 2017-18.

Appendix A

With the exception of meeting the target for the unique number of individuals served, Addiction Services for York Region is in compliance with the M-SAA for the fiscal year ending March 31, 2016. ASYR has increased the number of unique individuals served and is reviewing some of its current practices to determine how these can be modified to increase the number of individuals served.
